Importance of Trademark Registration |
A
Trademark (TM) or Service Mark (SM) is one of the vital and very significant
intellectual property assets of your company or firm, regardless of the
economic field you are ever engaged in. In general, the prime functions of a trademark
or service mark are the following:
Ø Distinguishing
any product or service of your company in the concerned marketplace
Ø Reflecting
the vision and reputation of your company/firm
Ø Advertising
the related product/service
Ø Establishing
publicity and popularity of your product/service in the relevant jurisdictional
market
Ø And,
offering a variety of legal authorities and rights for smooth, profitable, and
secure running of the business of your goods or product
Here,
it must be noted that only a duly registered trademark or service mark offers
all above-specified advantages, in addition to fortifying your exclusive legal
ownership over the trademark/service mark (referred to as ‘mark’, thenceforth).
Any unregistered mark cannot perform
these functions and is quite insecure and vulnerable to misuse or infringement
by other companies. Hence, registering a mark is strongly advisable in the
concerned country.
To
be readily registrable, a mark must be indubitably unique, besides being
scintillating and imaginative/visionary. These qualities of a mark are
ascertained through the nationwide trademark search across all relevant
trademark databases, after creation of the mark. Only then, recommended is
filing the application for trademark registration services with the proper office of
Trademark Registry.
